Australia has a restricted labour market, perhaps more so than many other countries around the world.  As a nation which does not share a land border with any other country Australia is unique in being able to regulate the flow of people, including skilled workers, to its borders.

As a result, Australia has developed a particularly complex migration compliance framework which requires strict adherence from visa holders and sponsoring employers alike.

In Australia it is illegal to employ a person who does not have valid work rights.  You may work in Australia if you are an Australian Citizen, hold a permanent residence visa for Australia, are a New Zealand Citizen who entered Australia on a New Zealand Passport, or hold  a valid Australian visa with work rights (such as a working holiday visa).

It is an offence under the Migration Act 1958 to knowingly or recklessly allow workers to work, or to refer workers for work, where those workers are from overseas and either illegally working in Australia or will be working in breach of their visa conditions.  It does not matter if the person is not being paid for the work.

People found to be working without valid work rights may be removed from the workplace without notice resulting possible disruption to the workplace.

People from overseas who work while in breach of their visa conditions of entry, or who work while illegally in Australia, are referred to as illegal workers. People convicted of these offences face fines of up to $13 200 and two years’ imprisonment.  Companies face fines of up to $66 000 per illegal worker.  These provisions apply to employers and labour suppliers who engage and/or refer illegal workers.

Therefore, it is important for companies operating in Australia to ensure that all staff, both foreign and domestic, have valid work rights.
