The forthcoming introduction of the Worker Protection Act will effect a number of legislative changes for employers including:

- More specifically define the sponsorship obligations of Australian employers

- Permit information sharing between government agencies, such as the ability of the Commissioner of Taxation to disclose information to a taxation officer

- Expand the powers of the Department of Immigration and Citizenship to monitor and investigate the possible non-compliance of Australian employers

- Introduce civil penalties for Australian employers found in breach of the sponsorship obligations.

Removal of foreign employment income tax exemption....

In the Federal Governments 2009/10 Budget of 12 May 2009, the Government announced that the current income tax exemption for foreign employment income earned by an employee working overseas for a continuous period of 91 days or more, would no longer be available to the vast majority of employees from 1 July 2009.

sc457 Occupation Changes

From 15 May 2009, ASCO Occupations 5-7 can no longer be nominated under Subclass 457 Standard Business Sponsorship (SBS) arrangements.   

These changes also apply to applications already lodged but undecided. For applications which no longer meet the requirements, DIAC says that "your case officer will give you the option to withdraw the application, and make a request for a refund."  "Refunds are available in particular situations. The department will be contacting those clients who may be entitled to a refund and providing them with an opportunity to withdraw relevant applications and request a refund. In general terms a refund will be available to those who have lodged a nomination or visa application that was not finalised before 15 May 2009 if the application has a nominated activity that has tasks that correspond to the tasks of an occupation in an ASCO 5-7 position. Approved nominations for ASCO 5-7 positions where a Subclass 457 visa has not been granted for this nomination may also be eligible to apply for a refund."

Government announces changes to 457 visa program

The Minister for Immigration has announced several important changes to the subclass 457 temporary worker visa program.

The changes are significant, particularly for employers of trade and related workers and associate professionals, but there are effects throughout the program which, combined with new departmental processes, will have wider implications for visa case handling.  Further changes are anticipated at the time of the May 2009 Federal Budget.  Contact our Immigration Manager, Sheila Woods, to discuss in detail.
